Veterans' Entitlements Regulations (Amendment)

The Governor-General may make regulations under section 216 of the Veterans' Entitlements Act 1986 (the Act) for the purposes of the Act.

The amending Regulations provide for the correction of a drafting error in regulation 14 and for the repeal of regulation 14A.

Details of the amending Regulations are set out below.

Regulation 1 - Amendment

The Veterans' Entitlements Regulations are amended as set out in these Regulations.

Regulation 2 - Regulation 14 (Contributions)

Regulation 14 prescribes the manner in which personal contributions accepted by the Repatriation Commission under section 200 of the Act are to be dealt with.

The amending Regulation corrects a drafting error by omitting "subsection 201(4)" and substituting "subsection 200(3)".

Regulation 3 - Regulation 14A (Recovery of overpayments prescribed educational schemes)

Regulation 14A of the Veterans' Entitlements Regulations defined "prescribed educational schemes" for the purposes of recovering overpayments under section 205 of the Act.

Section 91 of the Veterans, Affairs Legislation Amendment Act 1990 inserted the definition of "prescribed educational schemes" into subsection 205(8) of the Veterans' Entitlements Act 1986. Regulation 14A is therefore no longer required.

Regulation 14A is therefore repealed.
