This legislation has been repealed.
For the purposes of this Division, an eligible employee in relation to a workplace agreement is:
(a) in the case of an ITEA--the person whose employment will be subject to the ITEA; or
(b) in the case of a collective agreement--a person employed by the employer whose employment will, or would but for the operation of an ITEA that has passed its nominal expiry date, be subject to the agreement.
