This legislation has been repealed.
For the purposes of this Subdivision, an eligible employee in relation to a variation to a workplace agreement is:
(a) in the case of an ITEA--the employee; or
(b) in the case of a collective agreement:
(i) a person whose employment is subject to the agreement; or
(ii) a person employed by the employer whose employment will, or would but for the operation of an ITEA that has passed its nominal expiry date, be subject to the agreement as varied.
