Government Information (Public Access) (Consequential Amendments and Repeal) Bill 2009 No , 2009 A Bill for An Act to amend various laws as a consequence of the enactment of the Government Information (Public Access) Act 2009; to repeal the Freedom of Information Act 1989; and for other purposes. Insert instead: 14 124 Effect of Government Information (Public Access) Act 2009 15 (1) General rule 16 Except as provided by this section, nothing in this Act requires or 17 authorises any person or body to disclose information to another 18 person or body if there is an overriding public interest against the 19 disclosure of the information under the Government Information 20 (Public Access) Act 2009. 21 (2) Disclosure to person or body other than Tribunal 22 The provisions of the Government Information (Public Access) 23 Act 2009 continue to apply to the disclosure of information to any 24 person or body other than to the Tribunal as if this Act had not 25 been enacted. 26 (3) Disclosure to Tribunal 27 If a provision of this Act requires or authorises any person or 28 body to disclose information to the Tribunal in relation to any 29 proceedings before it and there is an overriding public interest 30 Page 5 Government Information (Public Access) (Consequential Amendments and Repeal) Bill 2009 Schedule 2 Amendment of other legislation against the disclosure of the information under the Government 1 Information (Public Access) Act 2009: 2 (a) the Government Information (Public Access) Act 2009 3 does not prevent the disclosure of the information to the 4 Tribunal, and 5 (b) the Tribunal is to do all things necessary to ensure that the 6 information is not disclosed to any person other than a 7 member of the Tribunal as constituted for the purpose of 8 the proceedings unless the person or body disclosing the 9 information to the Tribunal consents to the further 10 disclosure. 11 (4) Certificates by Director-General or Deputy Director-General 12 (General Counsel) of the Department of Premier and Cabinet 13 concerning Cabinet information 14 The Director-General or Deputy Director-General (General 15 Counsel) of the Department of Premier and Cabinet may certify 16 that information is Cabinet information. Any such certificate: 17 (a) is conclusive of that fact, and 18 (b) authorises any person who would otherwise be required 19 under this Act to lodge a document containing that 20 information with (or disclose the information to) the 21 Tribunal to refuse to lodge the document with (or disclose 22 the information to) the Tribunal. 23 (5) Definitions 24 In this section: 25 Cabinet information means information that is Cabinet 26 information under the Government Information (Public Access) 27 Act 2009. 28 disclose has the same meaning as it has in the Government 29 Information (Public Access) Act 2009. 30 [3] Schedule 2 Composition and functions of Divisions 31 Omit "Freedom of Information Act 1989" from clause 2 (1) of Part 4. 32 [4] Schedule 2, Part 4, clause 2 (1) 33 Insert in alphabetical order: 34 Government Information (Public Access) Act 2009 35 Page 6 Government Information (Public Access) (Consequential Amendments and Repeal) Bill 2009 Amendment of other legislation Schedule 2 [5] Schedule 2, Part 4, clause 5 1 Omit the clause.
