Defence to contravention
117 Defence to contravention
(1) In proceedings in which a person is charged with an offence of
contravening a requirement made of the person by an authorised officer
exercising a function conferred by this Part, it is a defence to the
prosecution of the offence if the person charged proves that the person had a
reasonable excuse for the contravention concerned.
(2) Subsection (1) does
not apply to a requirement made under Division 2.
(3) A requirement made
under Division 2 does not affect the privilege against self-incrimination as
it applies to a natural person, except where the authorised officer makes the
requirement in the case of an emergency. Note : See section 97.
