Offence of contravening conditions of accreditation
211 Offence of contravening conditions of accreditation
(1) A biosecurity certifier or former biosecurity certifier who contravenes a
condition of accreditation imposed by or under this Part is guilty of an
offence.
(2) An offence against this section is a category 2 offence.
(2A)
An offence against this section is an executive liability offence.
(3) A
person who is guilty of an offence against this section because the person
contravenes a requirement of a condition of accreditation to do or refrain
from doing something-- (a) continues, until the requirement is complied with
and despite the fact that any specified period or time for compliance has
expired or passed, to be liable to comply with the requirement, and
(b) is
guilty of a continuing offence for each day the contravention continues.
(4)
Subsection (3) does not apply to the extent that a requirement of a condition
is revoked.
