BIOSECURITY ACT 2015 - SECT 396

396 Evidence of publication of instruments on website

(1) The Secretary is to cause a record to be kept of the publication on a NSW Government website used by the Department of any of the following--

(a) an emergency order,

(b) a control order,

(c) a general biosecurity direction.

(2) The record must include--

(a) the date of publication, and

(b) the web address of publication, and

(c) the wording of the instrument as published.

(3) In any legal proceedings, a certificate issued by the Secretary and stating that records kept by the Secretary under this section indicate that an instrument referred to in subsection (1) was published on a NSW Government website used by the Department on a particular date is admissible and is evidence of the matters stated in the certificate.

(4) For the purposes of this section, a document purporting to be a certificate under this section is, unless the contrary is proved, taken to be such a certificate.
