Consultation requirements

86 Consultation requirements

(1) The Minister is not to recommend to the Governor the making of a biosecurity zone regulation that would authorise or require the destruction of any living thing that is a protected animal or protected plant within the meaning of the Biodiversity Conservation Act 2016 unless the Minister has certified that he or she consulted with the Minister administering that Act before recommending the making of the regulation.
(2) The Minister is not to recommend to the Governor the making of a biosecurity zone regulation that would authorise or require the destruction of any living thing that is a threatened species within the meaning of the Biodiversity Conservation Act 2016 unless the Minister has certified that he or she consulted with the Minister administering that Act before recommending the making of the regulation.
(3) The Minister is not to recommend to the Governor the making of a biosecurity zone regulation that would authorise or require the clearing of any native vegetation within the meaning of Part 5A of the Local Land Services Act 2013 unless the Minister has certified that he or she consulted with the Minister administering that Part of that Act before recommending the making of the regulation.
(4) The Minister is not to recommend to the Governor the making of a biosecurity zone regulation that would authorise or require harm (within the meaning of the Heritage Act 1977 ) to any building, work, relic, moveable object or place the subject of an interim heritage order or listing on the State Heritage Register under that Act unless the Minister has certified that he or she consulted with the Minister administering that Act before recommending the making of the regulation.
(5) A failure to comply with this section does not affect the validity of any regulation.
