Responsibilities of councils carrying out certain prescribed certification work
112 Responsibilities of councils carrying out certain prescribed
certification work
(1) A local council must ensure that any certification work of a class
prescribed by the regulations that is carried out on behalf of the local
council is carried out by a registered individual whose registration
authorises the individual to carry out that certification work. : Maximum
penalty--1,000 penalty units.
(2) A local council is taken to satisfy
subsection (1) if it engages a registered body corporate to carry out the
certification work.
(3) The Secretary may, with the approval of the Minister,
exempt a local council by written notice given to the local council from the
requirements of subsection (1).
(4) The approval of the Minister-- (a) may be
given with respect to a particular case or a class of cases, and
(b) may be
subject to conditions, and
(c) may be amended from time to time.
(5) Any
exemption given under this section-- (a) may be limited in time or subject to
conditions, or both, and
(b) may be revoked by the Secretary by written
notice given to the local council and must be revoked if the relevant approval
of the Minister is no longer in force.
