COMPANION ANIMALS ACT 1998 - SECT 44
Local Court has power to declare dog to be dangerous or menacing dog
(1) In any proceedings under this Act before the Local Court (other than an
appeal against a declaration by an authorised officer of a council that a dog
is a dangerous dog or against a refusal by a council to revoke such a
declaration), the Court may declare a dog to be a dangerous dog or a
menacing dog.
(2) A declaration by the Local Court has effect throughout the
State.
Note--: Section 11 requires the owner of a dog to notify the
Departmental Chief Executive when a dangerous dog or menacing dog declaration
is made or revoked by the Local Court.
