Application for approval in principle
106 Application for approval in principle
(1) A person may apply to the Regulatory Authority for the approval in
principle of proposed education and care service premises.
(2) An application
may be made if-- (a) the premises are for an education and care service (other
than a family day care service); and
(b) the premises are proposed to be
located in a new or existing Part 4 building; and
(c) under a Part 4 planning
law or Part 4 building law (or both) of the Part 4 jurisdiction, a permit or
approval is required for the construction, alteration or repair of the
proposed education and care service premises or the development of the land.
