Time for hearing
57 Time for hearing
(1) On the first return date for an application notice in any proceedings, or
at such later time as the court determines, the court must set the date, time
and place for hearing and determining the matter.
(2) The court must notify
the defendant of the date, time and place, if the defendant is not present.
(3) However, if the defendant is not present at the first return date or at
any subsequent mention of the proceedings, the court may proceed to hear and
determine the matter on the first or subsequent day on which the matter is
listed for mention at its discretion.
(4) The court may not proceed to hear
and determine the matter unless it is satisfied that the defendant had
reasonable notice of the first return date or the date, time and place of the
