Arrangements regarding classification of orders
82 Arrangements regarding classification of orders
(1) If a court is at any time unable to determine whether to make an
apprehended domestic violence order or an apprehended personal violence order,
it may make whichever apprehended violence order it thinks fit.
(2) If a
court is at any time unable to determine whether an apprehended violence order
was made, or should have been made, as an apprehended domestic violence order
or apprehended personal violence order, it may treat the order as having been
made as whichever type of apprehended violence order it thinks fit.
(3) If an
apprehended violence order is made or treated as having been made as an
apprehended domestic violence order or an apprehended personal violence order
but should have been made as another type of apprehended violence order, the
order is not invalid on that ground and is taken to have been made as that
other type of apprehended violence order.
