CRIMINAL ASSETS RECOVERY ACT 1990 - SECT 32D

Fees payable to NSW Trustee and Guardian

32D Fees payable to NSW Trustee and Guardian

(1) This section applies to an interest in property--
(a) over which the NSW Trustee and Guardian takes control in accordance with a restraining order or a notice given in accordance with section 21D(4), or
(b) vested in the NSW Trustee and Guardian on the forfeiture of the property under an assets forfeiture notice or assets forfeiture order.
(2) The NSW Trustee and Guardian may deduct the prescribed fees from the proceeds of the sale of an interest in the property.
(3) If the interest is not sold or otherwise disposed of, the NSW Trustee and Guardian may recover the prescribed fees from the Proceeds Account.
