CHILDREN'S GUARDIAN ACT 2019 - SECT 112
Review of adoption service providers
(2) The Children's Guardian is to monitor whether the Secretary and accredited
adoption service providers are carrying out their responsibilities with
respect to the provision of adoption services in accordance with this Act and
the regulations, and the Adoption Act 2000 and the regulations under that
Act. Note : Section 11 of the Adoption Act 2000 provides that it is an
offence for a person to provide an adoption service unless the person is the
Secretary or accredited under this Act as an adoption service provider.
(3) A
person who makes a statement, orally or in writing, that the person knows to
be false for the purposes of or in connection with subsection (1) or (2) is
guilty of an offence. : Maximum penalty--25 penalty units or imprisonment for
12 months, or both.
(4) Subsection (3) does not apply to a document if the
person, when giving the document-- (a) tells the Children's Guardian or an
officer of the Children's Guardian, to the best of the person's ability, how
it is false or misleading, and
(b) if the person has, or can reasonably
obtain, the correct information--gives the correct information.
