CIVIL LIABILITY ACT 2002 - SECT 54E
Additional matters relating to damages supervision orders
(1) A damages supervision order may-- (a) require an amount of damages to be
paid to the NSW Trustee and Guardian instead of, or by or on behalf of, the
person awarded the damages, and
(b) regulate the manner in which the NSW
Trustee and Guardian may exercise his or her functions under the order, and
(c) determine any matter relating to the payment of amounts of the damages,
including-- (i) the purposes for which amounts may be disbursed, and
(ii) the
obligations of the NSW Trustee and Guardian and the person awarded the
damages, and
(d) make such other provision as the court thinks fit in the
circumstances of the case.
(2) A damages supervision order ceases to have
effect-- (a) if it is revoked by a court, or
(b) on the death of the person
awarded the damages.
(3) If a damages supervision order ceases to have
effect, any remaining amount of damages, or the proceeds of an amount of
damages, is (subject to any order of a court and to payment of any fees or
other expenses of the NSW Trustee and Guardian) to be paid to the person
awarded the damages or the legal personal representative of the person.
