CONVEYANCERS LICENSING ACT 2003 - SECT 115
Receiver is taken to be beneficially entitled
115 Receiver is taken to be beneficially entitled
(1) Proceedings taken under this Division in the name of a receiver in
relation to any property may be so taken as if the receiver were beneficially
entitled to the property.
(2) If receivable property has been taken by, or
paid or transferred to, a person or otherwise used unlawfully or in breach of
trust, a receiver may take proceedings in the name of the receiver as if the
receiver were beneficially entitled to the property at the time the property
was so taken, paid, transferred or used.
