CRIMINAL PROCEDURE ACT 1986 - SECT 5
Certain offences to be dealt with on indictment
(1) An offence must be dealt with on indictment unless it is an offence that
under this or any other Act is permitted or required to be dealt with
summarily.
(2) An offence may be dealt with on indictment if it is an offence
that under this or any other Act is permitted to be dealt with summarily or on
indictment.
