Decision about committal or discharge
31F Decision about committal or discharge
(1) If the Children's Court is of the opinion that there is a reasonable
prospect that a reasonable jury, properly instructed, would convict the
accused person of an indictable offence, the Court must commit the
accused person for trial.
(2) If the Children's Court is not of the opinion
that there is a reasonable prospect that a reasonable jury, properly
instructed, would convict the accused person of an indictable offence, the
Court must immediately order the accused person to be discharged in relation
to the offence.
(3) Despite any requirement of section 31B, the Children's
Court may, at any time, on the application of the accused person, and with the
consent of the prosecutor, commit the accused person for trial.
