Transfer of property subject to a statutory trust to a beneficial owner
56A Transfer of property subject to a statutory trust to a beneficial owner
(1) This section applies if dutiable property that is vested in a person as
trustee of a statutory trust as a consequence of the making of an order under
section 66G of the Conveyancing Act 1919 is transferred or agreed to be
transferred by the trustee to one or more of the beneficial owners of the
dutiable property.
(2) The dutiable value of the dutiable property that is
the subject of the transfer or agreement is to be calculated by deducting from
the unencumbered value of the dutiable property or the consideration for the
transfer or agreement, whichever is the greater, the proportion of that amount
that is the same as the proportion of the purchaser's beneficial interest in
the dutiable property immediately before the transfer or agreement.
