General relationship of Act with other State legislation
44 General relationship of Act with other State legislation
(1) None of the following provisions operate to prevent, restrict or otherwise
limit the carrying out of a transaction arrangement or the exercise of a
function for the purposes of an authorised transaction-- (a) any provision of
the State Owned Corporations Act 1989 ,
(b) any provision of the Energy
Services Corporations Act 1995 ,
(c) any provision of the constitution of a
statutory SOC or a subsidiary of a statutory SOC.
(2) In the event of any
inconsistency between the provisions of this Act or the regulations and a
provision of any other State legislation that is prescribed by the regulations
as an inconsistent provision for the purposes of this section, the provisions
of this Act or the regulations (as the case may be) prevail to the extent of
the inconsistency.
(3) The requirements of any other Act (whether enacted
before or after this Act) for the approval by resolution of either or both
Houses of Parliament (or by Act) of any act that constitutes the transfer of
electricity network assets for the purposes of an authorised transaction is
satisfied by the enactment of this Act.
