(1) A decision of a consent authority under Part 4 in relation to an application for development consent or a development consent is (if this Division so provides) subject to appeal to the Court under this Division.
(2) A decision subject to appeal includes a decision made after a review under Division 8.2.
(3) There is no right of appeal under this Division against the following decisions--(a) a decision of the Independent Planning Commission as consent authority under this Act in relation to the carrying out of any development that is made after a public hearing by the Commission into the carrying out of that development,(b) the determination of, or a failure to determine, an application for a complying development certificate.
