Conduct of audits
97HB Conduct of audits
(1) The regulations may make provision for or with respect to the conduct of
audits by the Tribunal, the Scheme Administrator or other persons for the
purposes of this Part.
(2) Without limiting subsection (1), the regulations
may provide for the following matters-- (a) the matters that may be the
subject of an audit,
(b) the persons who may conduct an audit,
(c) the
functions that may be exercised by persons who conduct an audit,
(d) offences
relating to obstructing or hindering persons, or refusing or failing to comply
with requirements made by persons, who conduct audits.
(3) Each benchmark
participant or accredited abatement certificate provider is liable to pay to
the Treasurer the cost (as certified by the Tribunal or Scheme Administrator)
involved in and in connection with carrying out the Tribunal's or Scheme
Administrator's audit functions in relation to the participant or provider.
(4) Without limitation, a licence or accreditation may include terms and
conditions relating to the determination of the cost of carrying out those
functions.
