Surrender and seizure of firearms when licence suspended or revoked
25 Surrender and seizure of firearms when licence suspended or revoked
(cf APMC 4 (b), 1989 Act s 38)
(1) If a licence is suspended, revoked or
otherwise ceases to be in force, the person to whom it was issued must
immediately surrender to a police officer-- (a) any firearm in the person's
possession, and
(b) the licence.
: Maximum penalty--50 penalty units or
imprisonment for 2 years, or both.
(2) A police officer is authorised to
seize any firearm in the possession of a person if that person's licence is
suspended, revoked or otherwise ceases to be in force. A police officer is
also authorised to seize the licence itself.
(3) This section does not apply
in relation to a licence that has expired if the authority conferred by the
licence continues to have effect (as provided by the regulations) pending the
determination of an application for a subsequent licence.
