Unauthorised possession of firearms in aggravated circumstances
51D Unauthorised possession of firearms in aggravated circumstances
(1) A person who is in possession of more than 3 firearms is guilty of an
offence under this subsection if-- (a) the firearms are not registered, and
(b) the person is not authorised by a licence or permit to possess the
firearms.
: Maximum penalty--imprisonment for 10 years.
(2) A person who is
in possession of more than 3 firearms any one of which is a pistol or
prohibited firearm is guilty of an offence under this subsection if-- (a) the
firearms are not registered, and
(b) the person is not authorised by a
licence or permit to possess the firearms.
: Maximum penalty--imprisonment
for 20 years.
Note--: Reference to a pistol includes a prohibited pistol.
(3) If on the trial of a person for an offence under subsection (2) the jury
is not satisfied that the accused is guilty of the offence charged but is
satisfied on the evidence that the accused is guilty of an offence under
subsection (1), it may find the accused not guilty of the offence charged but
guilty of an offence under subsection (1), and the accused is liable to
punishment accordingly.
