GAMING MACHINES ACT 2001 - SECT 200
Offences by corporate hoteliers
200 Offences by corporate hoteliers
(1) If a hotelier that is a corporation contravenes (whether by act or
omission) any provision of this Act or the regulations, each person who
occupies a position of authority in the corporation is taken to have
contravened the provision if the person knowingly authorised or permitted the
contravention.
(2) If a hotelier that is a corporation is taken to have
contravened (whether by act or omission) a provision of this Act or the
regulations by reason of a contravention by the manager of the hotel, each
person who occupies a position of authority in the corporation is taken to
have contravened the provision if the person knowingly authorised or permitted
the contravention.
(3) A person may be proceeded against and convicted under
a provision in accordance with this section whether or not the corporation or
manager of the hotel has been proceeded against or convicted.
(4) This
section does not affect any liability imposed on a corporation or the manager
of a hotel for an offence committed by the corporation or manager under this
Act or the regulations.
