Determinations by review panel
30 Determinations by review panel
(1) A review panel is to review the matter in respect of which it has been
established.
(2) In considering the matter under review, the review panel--
(a) may conduct investigations, and
(b) may have regard to such evidence as
it considers relevant including, in particular, any submissions made by
persons who are (or who may be) affected by the matter.
(3) Except to the
extent to which the regulations otherwise provide, Division 7 of Part 3 of the
Independent Pricing and Regulatory Tribunal Act 1992 applies to an
investigation under this section in the same way as it applies to an
investigation under that Act, and so applies as if a reference in that
Division to the Tribunal were a reference to a review panel.
(6) The decision
of the review panel on the matter under review-- (a) takes effect on the day
on which it is given, or on such later day as may be specified in the
decision, and
(b) has effect as if it were a decision or order, as the case
requires, of the person by whom the original decision or order was made, and
(c) does not affect any access agreement or access determination that is in
force when it takes effect.
