Notice of entry
34I Notice of entry
(1) Before an authorised officer exercises a power of entry under this
Division, the Authority or an ETNO must give the owner or occupier of the
premises written notice of the intention to enter the premises.
(2) The
notice must-- (a) state the purpose for which the power is to be exercised,
and
(b) specify the day on which the authorised officer intends to enter the
premises, and
(c) be given to the owner or occupier of the premises before
that day.
(3) Notice is not required to be given to the owner or occupier of
the premises if-- (a) the owner or occupier consents to the entry, or
(b)
entry is required for an emergency.
