HEAVY VEHICLE NATIONAL LAW (NSW) - SECT 553
Requirement of person in control of thing to be seized
553 Requirement of person in control of thing to be seized
(1) To enable a thing to be seized under this Chapter, an authorised officer
may require the person in control of it-- (a) to take it to a stated
reasonable place by a stated reasonable time; and
(b) if necessary, to remain
in control of it at the stated place for a stated reasonable period.
(2) The
requirement-- (a) must be made by notice; or
(b) if for any reason it is not
practicable to give a notice, may be made orally and confirmed by notice as
soon as practicable.
(3) A person of whom a requirement is made under this
section must comply with the requirement, unless the person has a reasonable
excuse. : Maximum penalty--$10000.
