INDEPENDENT COMMISSION AGAINST CORRUPTION ACT 1988 - SECT 53
Referral of matter
53 Referral of matter
(1) The Commission may, before or after investigating a matter (whether or not
the investigation is completed, and whether or not the Commission has made any
findings), refer the matter for investigation or other action to any person or
body considered by the Commission to be appropriate in the circumstances.
(2)
The person or body to whom a matter is referred is called in this Part a
"relevant authority" .
(3) The Commission may, when referring a matter,
recommend what action should be taken by the relevant authority and the time
within which it should be taken.
(4) The Commission may communicate to the
relevant authority any information which the Commission has obtained during
the investigation of conduct connected with the matter.
(5) The Commission
shall not refer a matter to a person or body except after appropriate
consultation with the person or body and after taking into consideration the
views of the person or body.
(6) If the Commission communicates information
to a person or body under this section on the understanding that the
information is confidential, the person or body is subject to the secrecy
provisions of section 111 in relation to the information.
