JUDICIAL OFFICERS ACT 1986 - SECT 40
Suspension of judicial officers
(1) If-- (a) a complaint is made about a judicial officer or a report is made
by the Conduct Division setting out its opinion that a matter could justify
parliamentary consideration of the removal of a judicial officer from office,
or
(b) a judicial officer is-- (i) charged in New South Wales with an offence
that is punishable by imprisonment for 12 months or upwards or charged
elsewhere than in New South Wales with an offence that if committed in New
South Wales would be an offence so punishable, or
(ii) convicted in New South
Wales or elsewhere of such an offence, or
(c) a formal request, within the
meaning of Part 6A, has been made in respect of a judicial officer,
the
appropriate authority may suspend the officer.
(2) The appropriate authority
may lift the suspension at any time.
