Alternate members of Commission
45 Alternate members of Commission
(1) A judicial officer who is a member of the Commission may, with the
approval of the Commission, appoint another judicial officer to be an
alternate member of the Commission.
(2) The Governor may, on the nomination
of the Minister, appoint a person to be an alternate member of the Commission
for an appointed member of the Commission, and section 5 (5) applies in
relation to the person.
(3) During the absence or unavailability of a member
of the Commission the member's alternate-- (a) may act in the place of the
member, and
(b) while acting, shall have and may exercise the member's
functions as such a member and shall be deemed to be a member.
(4) An
appointment of an alternate member shall be for a specified period not
exceeding 12 months, but may be renewed.
(5) An appointment of an alternate
member under subsection (1) may be revoked at any time by the member of the
Commission who made the appointment or the Governor.
(6) An appointment of an
alternate member under subsection (2) may be revoked at any time by the
Governor.
