JUDICIAL OFFICERS ACT 1986 - SECT 48
Liability for proceedings
48 Liability for proceedings
(1) No matter or thing done by the Commission or Conduct Division or any
member of or any person acting under the direction of the Commission or
Division shall, if the matter or thing was done in good faith for the purpose
of executing this or any other Act, subject a member or a person so acting
personally to any action, liability, claim or demand.
(2) In proceedings for
defamation in relation to a complaint or in relation to any hearing or other
matter connected with a complaint, there is a defence of absolute privilege
for a publication to or by the Commission or Conduct Division or to any member
or officer of the Commission or Division, as such a member or officer.
