Compensation for interest not known to acquiring authority
53 Compensation for interest not known to acquiring authority
(1) If an authority of the State pays compensation under this Act to a former
owner of land without regard to the existence of an interest in the land owned
by another person (being an interest that was not known to the authority when
that compensation was paid)-- (a) that other person's entitlement to be paid
compensation by the authority in respect of the acquisition of that land is
extinguished, and
(b) his or her rights and entitlements against the former
owner in respect of the interest are not affected by the divesting,
extinguishing or diminution of the interest by this Act.
(2) For the purposes
of this section, an interest is known to an authority of the State only if it
is a registered interest or an interest within the actual knowledge of the
authority.
