LAW ENFORCEMENT CONDUCT COMMISSION ACT 2016 - SECT 112
Duty to notify Commission of declaration of critical incident
(1) The Commissioner of Police must ensure that the Commission is given notice
of the making of a critical incident declaration immediately after it is made.
(2) The notice is to include enough information about the critical incident
concerned for the Commission to make an initial assessment as to whether or
not the investigation of the critical incident should be overseen by the
Commission or whether further information is required before a decision with
respect to oversight can be made.
(3) The Commissioner of Police must ensure
that the Commission is given notice in writing if it is decided to revoke a
critical incident declaration or to otherwise cease the investigation of a
critical incident and the reasons for the revocation or cessation (an
"investigation cessation notice" ).
(4) Protocols and memoranda of
understanding may be entered into by the Commissioner of Police and the
Commission regarding the giving of notice and provision of information under
this section.
