LAW ENFORCEMENT CONDUCT COMMISSION ACT 2016 - SECT 134
Commission may report on Commissioner of Police's or Crime Commissioner's decision on Commission's request
(1) Instead of or in addition to a request made under section 103, 104 or 105
in relation to a police investigation or decision or
Crime Commission investigation or decision, the Commission may prepare a
report on the police investigation or decision or
Crime Commission investigation or decision.
(2) The report may include such
comments and recommendations as the Commission considers appropriate.
(3) The
Commission is to provide a copy of the report to each of the following-- (a)
the complainant,
(b) the Minister,
(c) in the case of a police investigation
or decision, the Commissioner of Police,
(d) in the case of a
Crime Commission investigation or decision, the Crime Commissioner.
(4) The
Commissioner of Police or Crime Commissioner is then to provide a copy of the
report to the police officer or administrative employee or
Crime Commission officer, respectively, whose conduct was the subject of the
misconduct matter unless the Commission, in providing a copy of the report
under subsection (3), has advised that it would be inappropriate to do so.
