LAW ENFORCEMENT CONDUCT COMMISSION ACT 2016 - SECT 145
Commission or Inspector may omit matter from reports
(1) The Commission or Inspector may omit any matter from a copy of a report
given to a complainant or an administrative employee, Crime Commission officer
or a police officer (other than the Commissioner of Police or
Crime Commissioner) under this Act if the Commission or Inspector thinks it is
in the public interest to do so.
(2) The Inspector may omit any matter from a
copy of a report given to a complainant or an officer of the Commission (other
than a Commissioner) under this Act if the Inspector thinks it is in the
public interest to do so.
(3) The Commission or Inspector must omit
critical police information and critical Crime Commission information from a
copy of a report given to a complainant or an administrative employee,
Crime Commission officer or police officer (other than the Commissioner of
Police or Crime Commissioner) under this Act.
(4) The Commission or Inspector
must include in a report the Commission's or Inspector's recommendation as to
whether or not the report (or any part of the report) should be made public
and, if the report or part is made public, whether it should be made public
immediately or at a later time.
(5) The Commission or Inspector may include a
recommendation that certain matter be omitted from a report (or part of a
report) that is made public.
