LAW ENFORCEMENT CONDUCT COMMISSION ACT 2016 - SECT 43
Notice of misconduct matters to be given by Commission
(1) As soon as practicable after receiving or becoming aware of a
misconduct matter concerning a police officer or administrative employee or
the NSW Police Force, the Commission is to give the Commissioner of Police
notice of the misconduct matter.
(2) As soon as practicable after receiving
or becoming aware of a misconduct matter concerning a Crime Commission officer
or the Crime Commission, the Commission is to give the Crime Commissioner
notice of the misconduct matter.
(3) The notice may include a summary or
sufficient details of the misconduct matter to indicate the nature of the
misconduct for the information of the Commissioner of Police or
Crime Commissioner.
(4) Nothing in this section requires a copy of a
misconduct matter to be referred to the Commissioner of Police or
Crime Commissioner if the Commissioner of Police or Crime Commissioner already
has a copy (or a summary or sufficient details) of the misconduct matter.
(5)
The Commission is not required to give notice of a misconduct matter under
this section if the Commission is of the opinion that it is not in the public
interest to do so.
