Conditional release of contemnor
94 Conditional release of contemnor
(1) A Commissioner may by order release a contemnor detained under section 93
at any time before the contemnor is brought before the Supreme Court.
(2) The
release must be subject to the condition that the contemnor appear before the
Supreme Court.
(3) The release may (but need not) be made subject to-- (a)
one or more conditions for the purpose of ensuring the appearance of the
contemnor before the Supreme Court (for example the provision of sureties by
the contemnor, the surrender of any passport held by the contemnor, a
requirement as to where the contemnor is to live and regular reporting by the
contemnor to the Commissioner), and
(b) any other conditions.
(4) From time
to time, the Commissioner may by order amend, revoke or add to those
conditions.
Note : It is an offence to fail, without reasonable excuse, to
comply with a condition of a release order--see section 150 (3).
