Preliminary assessment of complaint
276 Preliminary assessment of complaint
(1) The designated local regulatory authority must conduct a preliminary
assessment of a complaint.
(2) When conducting the preliminary assessment--
(a) the designated local regulatory authority may request further information
to be provided within a specified period by the complainant, the respondent or
another person who may have relevant information; and
(b) the designated
local regulatory authority is not bound by rules of evidence and may inform
itself on any matter in any manner as it thinks fit.
(3) Any evidence or
information obtained by the designated local regulatory authority in the
course of conducting a preliminary assessment may be used by the designated
local regulatory authority or an investigator in or in relation to any later
investigation or consideration of the complaint.
(4) The designated local
regulatory authority may complete a preliminary assessment even if requested
information is not provided within the specified period.
