Lien for costs on regulated property
339 Lien for costs on regulated property
(1) This section applies if-- (a) a manager has been appointed for a law
practice; and
(b) the law practice or a legal practitioner associate of the
law practice claims a lien for legal costs on regulated property of the law
practice.
(2) The manager may serve on the law practice or legal practitioner
associate a written notice requiring the law practice or associate to give the
manager within a specified period of not less than one month-- (a) particulars
sufficient to identify the regulated property; and
(b) a detailed bill of
costs.
(3) If the law practice or legal practitioner associate requests the
manager in writing to give access to the regulated property that is reasonably
necessary to enable the law practice or associate to prepare a bill of costs
in compliance with subsection (2), the time allowed does not begin to run
until the access is provided.
(4) If a requirement of a notice under this
section is not complied with, the manager may, in dealing with the regulated
property claimed to be subject to the lien, disregard the claim.
