Investigator's power to enter premises--trust records investigations, compliance audits and complaint investigations
374 Investigator's power to enter premises--trust records investigations,
compliance audits and complaint investigations
(1) For the purpose of carrying out a trust records investigation, compliance
audit or complaint investigation, an investigator may enter and remain on
premises to exercise the powers in section 375.
(2) The investigator may
enter premises-- (a) with the consent of the occupier; or
(b) under the
authority of a search warrant issued under this Part; or
(c) in the case of
non-residential premises--without the consent of the occupier and without a
warrant, but only if-- (i) the investigator believes, on reasonable grounds,
that it is urgently necessary to do so in order to prevent the destruction of
or interference with relevant material; and
(ii) the designated local
regulatory authority in the particular case has authorised the investigator
(orally or in writing) to do so.
