LEGAL PROFESSION UNIFORM LAW (NSW) - SECT 379
Search warrants--details of warrant to be given to occupier
379 Search warrants--details of warrant to be given to occupier
(1) If the occupier is present at premises where a search warrant is being
executed, the investigator must-- (a) identify himself or herself to the
occupier; and
(b) give to the occupier a copy of the warrant.
(2) If the
occupier is not present at premises where a search warrant is being executed,
the investigator must-- (a) identify himself or herself to a person at the
premises; and
(b) give to the person a copy of the warrant.
(3) An
investigator executing a search warrant must, at the reasonable request of a
person apparently in charge of the premises or any other person on the
premises, produce the warrant.
