Cancellations of authorities
126 Cancellations of authorities
(1) Before cancelling an authority, otherwise than at the request of the
holder of the authority, the decision-maker is to cause a written notice to be
served on the holder of the authority that contains the following-- (a) notice
that the authority is proposed to be cancelled,
(b) details of the grounds
for the proposed cancellation,
(c) notice that the holder of the authority
has a specified period (of at least 28 days) in which to make representations
with respect to the proposed cancellation.
(2) The decision-maker must not
cancel an authority, otherwise than at the request of the holder of the
authority, unless-- (a) the decision-maker has taken any such representations
received from the holder of the authority into consideration, or
(b) the
period specified in the notice has elapsed and no such representations have
been received.
(3) The decision-maker is to cause written notice of the
cancellation of an authority to be given to the holder of the authority.
(4)
The cancellation takes effect on the date on which the written notice of the
cancellation is given to the holder of the authority, or on a later date
specified in the notice.
(5) The cancellation of an authority does not affect
any liability incurred by the holder of the authority before the cancellation
took effect.
