MINING ACT 1992 - SECT 171

171 Certain claims for damages prohibited

(1) No action lies against the Crown, the Minister or any person administering this Act in respect of any injury or loss suffered or incurred in relation to the exercise of any right conferred by an authority.

(2) Subsection (1) does not affect any liability of the Crown in respect of any injury or loss suffered or incurred in relation to the exercise of any right conferred by an exploration licence held by the Secretary on behalf of the Crown.

Note : The Secretary may hold an exploration licence on behalf of the Crown--see section 364.
