MINING ACT 1992 - SECT 270
Compensation arising under environmental assessment permit
(1) If the holder of an environmental assessment permit enters any land under
the authority of the permit, landholders become entitled to compensation from
the holder of the permit for any compensable loss they suffer as a result of
the exercise of the rights conferred by the permit.
(2) The amount of
compensation payable under this section is such amount as may be assessed by
the Land and Environment Court on the application of the holder of the
environmental assessment permit, the Crown or the landholder concerned.
(3)
Nothing in this section affects any remedy available to any person whose lands
are entered pursuant to a power conferred by or under Part 12.
