Method of assessing degree of impairment
133 Method of assessing degree of impairment
(1) The assessment of the degree of permanent impairment of an injured person
as a result of the injury caused by a motor accident is to be expressed as a
percentage in accordance with this Part.
(2) The assessment of the degree of
permanent impairment is to be made in accordance with-- (a)
Motor Accidents Medical Guidelines issued for that purpose, or
(b) if there
are no such guidelines in force--the American Medical Association's Guides to
the Evaluation of Permanent Impairment, Fourth Edition.
(3) In assessing the
degree of permanent impairment under subsection (2) (b), regard must not be
had to any psychiatric or psychological injury, impairment or symptoms, unless
the assessment of the degree of permanent impairment is made solely with
respect to the result of a psychiatric or psychological injury.
