MOTOR ACCIDENTS COMPENSATION ACT 1999 - SECT 47
Payment for treatment and lost earnings of injured persons
(1) Insurers are required to pay the treatment expenses and lost earnings of
injured persons in the circumstances and to the extent provided by this Part.
(2) Payment for treatment expenses and lost earnings is not required under
this Part to the extent that-- (a) they are paid for by the insurer under a
claim made in respect of the matter, or
(b) (in the case of treatment
expenses) they are paid or recovered under Part 3.3 (Payments to hospitals,
doctors and others).
(3) Payment is not required under this Part for
treatment expenses or lost earnings incurred after a claim is made in respect
of the matter.
(4) An insurer is not required to pay for lost earnings under
this Part if the insurer is reasonably of the opinion that the claimant is
likely to make a claim in respect of the matter because the claimant is
entitled to recover damages in excess of the amount that would otherwise be
payable under this Part or is entitled to recover under other heads of damage.
