MOTOR ACCIDENTS (LIFETIME CARE AND SUPPORT) ACT 2006 - SECT 23
Assessment of treatment and care needs of participants
(1) The Authority is to make an assessment of the treatment and care needs of
a participant in the Scheme.
(2) The assessment is an assessment of the
participant's treatment and care needs that are reasonable and necessary in
the circumstances, and as relate to the motor accident injury in respect of
which the person is a participant in the Scheme.
(3) An assessment of
treatment and care needs is to be made in accordance with the LTCS Guidelines.
(4) The Authority is to certify in writing as to its assessment of the
treatment and care needs of the participant including its reasons for any
finding on which the assessment is based, and is to give a copy of the
certificate to the participant.
