MENTAL HEALTH ACT 2007 - SECT 190
Act does not limit or affect other powers
190 Act does not limit or affect other powers
(1) Nothing in this Act or the Mental Health and Cognitive Impairment
Forensic Provisions Act 2020 limits or affects any power conferred on a police
officer or any other person by or under any other law with respect to
stopping, searching or detaining a person (whether or not a patient) or taking
any such person to any place.
(2) Nothing in this Act or the
Mental Health and Cognitive Impairment Forensic Provisions Act 2020 prevents
an authorised medical officer from taking any action that the officer thinks
fit to protect a patient or person detained in a mental health facility, or
any other person in a mental health facility, from serious physical harm.
